* Under Color of Law
The conduct of the officer “under color of law” is important, because he acts with legal authority when violations are committed.  There are two important Federal civil right statutes, 18 U.S.C 242 and companion statute 18U.S.C. 241. These make it a federal offense with fines and imprisonment or both when you injure, oppress, threaten and intimidate any citizen in “free exercise of his or her rights protected by the Constitution and the laws of the United States.” Both of these statues are important to understand when filing an action against a law enforcement officer who abuses his authority and find himself defending a 242 criminal action or a 1983 damage suit.
